Camden County Train Accident Lawyers Report: First Lawsuit Filed in Deadly Amtrak Train Derailment

Just two days after the devastating train derailment accident that killed eight people and injured over 200 others, the first federal lawsuit has been filed by an employee of Amtrak. Bruce Phillips’ lawyer has reported that his client is seeking more than $150,000 for injuries he suffered as a passenger in the last car of the ill-fated train.
Phillips was riding in Amtrak Northeast Regional train 188, which derailed in the Port Richmond section of Philadelphia. Not on duty at the time, he was riding for no charge, or “deadheading” from Philadelphia to New York City, and had just boarded the train at Philadelphia’s 30th Street Train Station. Deadheading is a free of charge transport for an employee who is not working.
Phillips alleges that the catastrophic train accident caused him to be violently tossed about the car as it careened around the curve and then ran off the tracks. He finally came to rest on the floor of the train after sustaining serious injuries to his brain, as well as cuts and bruises. Phillips asserts that he suffered emotional trauma and has serious orthopedic and neurological insults, for which he is under treatment at Temple University Hospital.
Additionally, Mr. Phillips claims lost earnings and diminished future earning power as a result of his injuries. He reports that he will have to expend a great deal of money for current and future medical care and rehabilitation. The great physical pain and mental anguish he suffered is also part of his claim. Mr. Phillips and his wife are also seeking punitive damages for the gross negligence he asserts caused the train accident.
