Comparative Fault

There is a modified comparative fault clause in New Jersey that requires both parties to share blame for a car accident, should your accident claim go through the courts. A judge will review the case, then the jury will decide who shares the larger percentage of blame. Other comparative fault states would allow you to recover damages, even if you are found liable for the car accident.

You must also report the car accident to the local police department right away if your damages are thought to be over $500. Drivers must also fill out an accident report and send it to the New Jersey Department of Transportation within 10 days of the car accident. New Jersey law also requires you to follow a statute of limitations of two years to report an injury claim through the court system.
